GENERAL TERMS AND CONDITIONS

Please read the following terms and conditions carefully. Together with the Information on the Rentals and the details on the Villa Page these are the terms of your booking. By booking with Vida Rústica you accept these terms.

 

1 Reservation

You can make a Booking by Internet, e-mail phone or regular mail. All these ways of Booking are binding.

 

2 Reservation cost

€ 25, – will be charged per Booking. For a Booking of different locations in sequential weeks Vida Rústica charges the Reservation cost only once.

 

3 Booking confirmation and payment

As soon as we have received your Booking form and a confirmation of the owner that the villa is blocked for you, we will send you a non-binding Pre-reservation. Upon receipt of your confirmation we will send your Booking confirmation and invoice for the rental sum, down payment, reservation cost and breakage deposit (if applicable). It is at this time that a contract comes into existence between you and the owner of the villa of your choice.

A deposit of 30% of the rental sum is to be paid to Vida Rústica upon confirmation within 7 days. Upon receipt of the deposit, we will send your information pack with all required information by regular mail. The balance is due 6 weeks before your arrival. If you make your Booking less than 6 weeks before the rental date, full payment is required upon confirmation. In case we might not receive the balance on the due date we reserve the right to cancel your Booking and levy the cancellation charges (as set out in clause 6).

 

4 Liability for the renter

The Main Guest will be responsible for the rented villa, interior and assets belonging to the villa during the stay. The Main Guest shall completely reimburse any damage to the villa caused by him or his party. The Main Guest has to report any damage caused to the House manager, and pay the reimbursement to Vida Rústica. Vida Rústica has the right to lay responsibility on the renter/tenant if the damage caused has not been fully repaid.

 

5 Liability for Vida Rústica

We accept responsibility that the villa is as described in the brochure and web site. If it is not made available as promised due to the fault of our employees or suppliers, we will try to solve this a.s.a.p. If we might not succeed, we will pay you appropriate compensation to the maximum of the rental sum paid. For unexpected changes of which we had no knowledge we are not responsible. We do not accept liability whatsoever for any death, personal injury, loss or damage of whatever kind, to the renters, or any other people present in the villa during the rental period.

 

6 Cancellation by the Guest

Vida Rústica advises the Main Guest to cover the risk of cancellation through an appropriate insurance. To cancel your Booking you have to inform Vida Rústica by phone and (e-)mail. Vida Rústica will confirm your cancellation upon receipt. Reservation cost will not be reimbursed. A Booking can be annulled within 7 days from the date of confirmation. In this case Vida Rústica will return your deposit. If you cancel the Booking more than 7 days after confirmation, but more than 6 weeks before the start of the rental period, 30% of the rental sum is due. For cancellation within 6 weeks before the start of the rental period, 100% of the rental sum is due. If you make your Booking less than 6 weeks before the start of the rental you do not have the right to annul within 7 days and a 100% payment is due.

 

7 Cancellation by Vida Rústica

In the unlikely case that Vida Rústica has to cancel a Booking we will notify you immediately and try to offer an alternative. In case of non-acceptance of the alternative by the renter, Vida Rústica will reimburse the renter all payments made and the renter loses any rights other than the reimbursement of payments made.

 

8 Complaints

If despite all our efforts the villa does not live up to your expectations, you should immediately inform the House manager. If your justified complaint might not be solved satisfactorily, you have to immediately contact Vida Rústica, such as to enable us to assist in solving the problem during your stay. Leaving the villa before the end of the rental period and without mutual agreement will release Vida Rústica of any obligation to pay a compensation. Justified complaints that have not been solved satisfactorily should be reported by  e-mail to Vida Rústica within 2 weeks after the rental period.

 

9 Applicable law

Dutch law will be applicable with respect to conflicts, which may arise as a result of this agreement.
